Terms of service

The deal between your business and Kiwifront, in plain English. No lock-in, and nothing hidden in the small print.

The short version

  • Your preview is free, with no card and no obligation.
  • If you go live, you pay monthly, plus GST, by card through Stripe. No setup fee.
  • Content changes are unlimited (fair use). New pages and features are quoted first.
  • You own your content, and your web address stays in your name.
  • Cancel any month, with no cancellation fee.
  • Kiwifront is for businesses, so the Consumer Guarantees Act doesn't apply.

About these terms

These terms are an agreement between your business ("you") and Kiwifront, a New Zealand business ("we" or "us").

They apply when you ask for a free preview and when you subscribe to a plan. By doing either, you agree to them. If you're agreeing for a company or other business, you confirm you're allowed to.

Kiwifront is a service for businesses. By using it, you confirm you're acquiring it for the purposes of a business.

The free preview

  • It's free, with no obligation. You don't need a card, and you don't owe us anything if you decide not to go ahead.
  • We build it from what you tell us and from information already public about your business, such as your current website or Google Business Profile. It may use sample words or photos until you give us your own.
  • Your preview has a private link and isn't listed on search engines.
  • Until you subscribe, the preview's design and code are ours. Please don't copy them or have someone else rebuild them.
  • If it's not for you, just tell us. We'll take the preview down and delete it within 30 days. If we don't hear back within 30 days, we'll take it down too.

Going live and paying

When you approve your preview and pay your first month, your subscription starts that day. We'll then put your website live on your web address.

  • Prices are in New Zealand dollars and don't include GST (15%), which is added to every invoice.
  • There's no setup fee. Extra pages are $9 a month each + GST. Extras, such as online bookings, are listed on our pricing page.
  • You pay monthly in advance, on the same date each month, by card through Stripe. We email you a GST tax invoice for every payment.
  • Some extras use another company's tool (for example a booking or ordering platform). That company charges its own fees, under its own terms.
  • If a payment fails, we'll let you know and Stripe will try again. If it's still unpaid after 14 days, we may pause your website until it's paid.

Your plan sets the most pages your website can have. If you need more, you can add extra pages or move to a bigger plan.

Changes to your website

Content changes are unlimited. New photos, prices, opening hours, menu items, staff and words: just ask, and there's no charge per change. We work through them one at a time, in the order they arrive.

That's our fair-use rule. New pages, new features or a full redesign are bigger jobs, so we quote them first, in writing, and only start once you've said yes. We never charge for work you didn't approve.

If requests ever go well beyond what a small business website normally needs, we'll talk with you about it before anything changes.

Your content

  • You own your content: your words, photos, logo, business name and other material you give us.
  • You let us use, copy and adapt it to build, host and look after your website while you're a customer.
  • You confirm you have the right to use it (for example, photos taken by someone else), and that it's accurate and lawful.
  • You're responsible for what your website says about your business, such as prices, specials and qualifications. We'll put it up the way you ask, but the claims are yours.
  • We'll only show your website as an example of our work if you say we can.

Your web address

Your web address (for example, yourbusiness.co.nz) is registered in your name, so it's always yours.

If you leave, you keep it, and we'll help you point it wherever you like.

Our designs and code

The designs, layouts, templates, code, animations and tools we use to build websites belong to us (or to the people who license them to us). While you're subscribed, you have a licence to use them for your own business website.

You can't copy, sell or reuse them for another website. Any photos or images we provide (rather than you) are licensed for use on your website while you're subscribed.

Using your website fairly

Your website mustn't be used for anything that:

  • breaks New Zealand law, or is objectionable;
  • infringes someone else's copyright, trade mark or other rights;
  • is false or misleading, or harasses, threatens or defames anyone;
  • sends spam, spreads malware or tricks people into giving away their details;
  • collects people's personal information without telling them how it'll be used.

If something on your website breaks these rules, we'll tell you and ask you to fix it. If it's serious or urgent, we may remove it or pause your website first, and then tell you why.

Keeping your website online

Your website runs on Cloudflare's global network. We use reasonable efforts to keep it online, fast and secure, and we keep copies so we can restore it if something goes wrong.

We can't promise it will never be unavailable. Short outages can happen, for maintenance or because of problems at services we rely on, such as Cloudflare, Stripe or a booking tool. If something goes wrong, we'll work to fix it as quickly as we reasonably can.

Cancelling

Your plan runs month to month. Cancel any time, with no cancellation fee. Use the link in your invoice email, or email support@kiwifront.co.nz.

  • Your cancellation takes effect at the end of the month you've already paid for. We don't refund part months, except where the law says we must.
  • Your website goes offline at the end of that month.
  • Within 5 working days of you asking, we'll send you a copy of your content (your words, photos and logo), free.
  • We'll help you move your web address and remove our access to it. Any email forwarding we set up stops, so please set up another option before then.
  • We delete our copies within 90 days, except records the law requires us to keep.

If we need to end or pause

We can end your subscription for any reason by giving you at least 30 days' notice by email. We'll refund anything you've paid for time after it ends.

We can pause or end it sooner if you seriously break these terms, for example by not paying after we've reminded you, or by using your website for something unlawful. Where we can, we'll warn you first and give you a chance to fix it.

If Kiwifront ever stops trading, we'll give you at least 30 days' notice and send you a copy of your content.

Price and terms changes

We'll give you at least 30 days' notice by email before we change your price or make an important change to these terms. If you don't want to continue, you can cancel before the change starts, at no cost. If you stay on, the change applies from your next billing date.

Our liability

We'll always do our work with reasonable care and skill. So that our prices can stay low:

  • we're not responsible for indirect losses, such as lost profits, lost sales or lost business opportunities;
  • our total liability to you for any claim is limited to the fees you paid us in the 12 months before it;
  • if someone makes a claim against us because of content you gave us (for example, a photo you didn't have the right to use), you'll cover our reasonable costs of dealing with it.

Nothing in these terms limits any liability that the law doesn't allow to be limited.

Business customers and consumer law

Our services are supplied and acquired in trade. You and we agree that the Consumer Guarantees Act 1993 doesn't apply to them, as section 43 of that Act allows, and that this is fair and reasonable.

We don't try to contract out of the Fair Trading Act 1986. We stand behind what we tell you, and we don't make misleading claims about our services.

If you're actually buying for personal or household use rather than for a business, please tell us. In that case the Consumer Guarantees Act does apply, and this section doesn't.

Privacy

We look after your personal information as our privacy policy explains.

Disputes and New Zealand law

If something isn't right, please talk to us first at support@kiwifront.co.nz. Most things can be sorted out quickly.

These terms are governed by New Zealand law, and the New Zealand courts (including the Disputes Tribunal) can hear any dispute about them.

These terms, together with the plan you choose and any written quote you accept, are the whole agreement between us. If one part turns out not to be enforceable, the rest still applies. We may transfer this agreement to someone who takes over our business, and we'll tell you if that happens.
